In case against Pakistan’s top-most IT firm – Axact, FIA counsel Shahab Usto finally admitted that the Federal Investigation Agency (FIA) does not possess any direct evidence against the said company. Twenty-fourth hearing for the bails of 9 personnel of Axact held in Sindh High Court on Thursday.
Honorable court censured FIA and said that since FIA does not have the direct evidences against the respondent then why FIA wasting time of court by presenting old tools and stories rather than presenting charge sheet as victims already suffered plethora of unjustified media trial. Unless the crime is proven, it cannot be pronounced that wrong doings actually committed,
thus, no more arguments are supposed to be reproduced on this legal forum. When honorable court lambasted over the delaying tactics of FIA, then public prosecutor compelled to admit that FIA does not possess any direct evidences – against the company being subject to unjustified trial.
When public prosecutor went on to the streak of already 10-month delayed case, honorable court asked as to why final charge sheet has not been produced before court, what is the reason behind for such a delay?
Justice Syed Farooq Shah of SHC asked to Shahab Usto that you had to produce final charge sheet within 14 days, nonetheless, why are you still wasting time by concocting old stories? He said “Victims already subjected to media trial, so no more old arguments be repeated here, after the advent of Internet world has become a global village, so unless a crime is proven, nobody can be called guilty.”
Justice Syed Farooq Shah asked the FIA counsel that you mentioned 300 websites in your case, so have you recorded statements from the individuals representing those 300 websites? Not a single statement has been recorded, replied FIA counsel. Justice Shah further asked to FIA counsel that, do they have complete evidence that these websites are pertinent to the said case? FIA does not have any kind of evidence in Axact case, says counsel.
Justice Shah then outbursts over the reply, went on to ask as to how much evidence gathered, so far, from the witnesses, moreover, why you brought bundle of documents in court, whether you brought these tools merely to waste the time of court? However you are supposed to produce quality evidence instead of legally hollow bundles of documents in huge quantity. Axact counsel Amir Mansoob brought the attention of honorable court in the case while saying that FIA counsel presenting stories in court which are irrelevant to the said case.
While noting the concrete argument of defense counsel honorable judge said, “We have heard of your unfounded arguments enough, conclude your discourse by Tuesday from 12 AM to 1.30 PM. During the hearing, respondent to the case and Investigation Officer Saeed Memon were also present in the court along with another private lawyer Salah Uddin Gandapore. Meanwhile, hearing adjourned till next Tuesday.
